Terms of Service

Agreement to Terms

By accessing or using BetterPost at betterpost.io or via our Telegram bot, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

BetterPost is operated by PE Mykhalchuk Dmytro Oleksandrovych (Kyiv, Ukraine).

By using the service you also agree to our Privacy Policy, which explains how we collect and use your personal data.

Description of Service

BetterPost is a social media content automation tool for small businesses. You describe what's happening in your business, provide photos if you have them, and BetterPost generates and publishes ready-to-go posts to your connected social media accounts.

BetterPost is a software tool — not a marketing agency. You remain fully responsible for the content published to your accounts.

Account Registration

To use the service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must be at least 18 years old to use BetterPost.

Connecting Social Media Accounts

By connecting your Instagram or Facebook account via OAuth, you authorize BetterPost to:

• Publish content to your connected accounts on your behalf
• Access basic account information necessary for publishing (account ID, profile name)
• Retrieve post insights (reach, engagement) to provide recommendations

We do not access your direct messages, personal feed, or any data beyond what is needed to operate the service. We do not post content without your knowledge.

Our use of data obtained through Meta APIs complies with the Meta Platform Terms and Meta Developer Policies. Connecting your account does not transfer responsibility for it — you remain solely responsible for your social media accounts and for ensuring all content published through BetterPost complies with Instagram's, Facebook's, and any other connected platform's own terms of service and community standards.

You can revoke access to any connected account at any time from your Facebook App Settings or from within BetterPost.

Content and Intellectual Property

Your content

You retain ownership of all content you provide to us — including photos, text briefs, and brand assets.

Generated content

Posts and graphics created by BetterPost on your behalf become your property upon creation. You may use, modify, or repurpose them as you see fit. BetterPost does not use your content to train AI models.

Our intellectual property

The BetterPost platform — including its design, software, and AI workflows — remains our intellectual property. Your subscription grants you a limited, non-exclusive license to use the platform for its intended purpose.

Content Review

BetterPost generates content automatically using AI. AI-generated content may occasionally contain errors or require editing. You are responsible for reviewing content before it is published. BetterPost is not liable for content published with your approval that may be inaccurate, inappropriate, or in violation of third-party rights.

Acceptable Use

You agree not to use BetterPost to:

• Publish unlawful, harassing, defamatory, or fraudulent content
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Distribute spam or unsolicited communications
• Reverse-engineer, decompile, or attempt to access our source code
• Resell or redistribute the service without written permission
• Violate Meta's Terms of Service, Community Standards, or any other connected platform's policies

We reserve the right to suspend or terminate accounts that violate these terms.

Subscriptions and Payment

Plans and pricing

BetterPost offers a free trial and paid subscription plans as described at betterpost.io. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

Billing

Subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation

You may cancel your subscription at any time from your account settings or by contacting us. Upon cancellation:

• You retain access through the end of your current billing period
• No further charges will be applied
• Any scheduled posts in the queue will not be published after your billing period ends
• Your data will be retained for 30 days, then permanently deleted

Refunds

EU / EEA / UK You have the right to withdraw within 14 days of your first purchase under EU consumer law. Contact hello@betterpost.io to exercise this right.

All other users We offer a goodwill refund within 7 days of first purchase if you are unsatisfied. Contact hello@betterpost.io.

Termination

You may stop using the service and delete your account at any time by contacting hello@betterpost.io.

We reserve the right to suspend or terminate your access immediately and without prior notice if you:

• Violate these Terms of Service
• Violate Meta's Platform Terms or Community Standards through your use of BetterPost
• Use the service for unlawful purposes
• Engage in activity that could expose BetterPost or other users to legal or reputational harm

If we discontinue the service entirely, we will provide at least 30 days' notice and refund any prepaid fees for the unused period.

Service Availability

We strive to maintain reliable uptime but do not guarantee uninterrupted service. We are not liable for temporary unavailability due to maintenance, updates, or circumstances beyond our control. Social media platform API changes or outages may temporarily affect publishing.

Limitation of Liability

To the maximum extent permitted by applicable law, BetterPost is not liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or business opportunities — arising from your use of the service.

This includes: interruptions to the service, actions taken by third-party platforms (such as account suspension by Meta), or AI-generated content that you have reviewed and approved.

Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim. Nothing here limits our liability for fraud or gross negligence, or where prohibited by mandatory consumer protection law in your jurisdiction.

Indemnification

You agree to indemnify and hold harmless BetterPost and PE Mykhalchuk Dmytro Oleksandrovych from any claims, damages, or expenses arising from your use of the service, your violation of these terms, or your violation of any third-party rights.

Governing Law

These terms are governed by the laws of Ukraine, where the company is registered.

EU / EEA / UK If you are a consumer in the EU, EEA, or UK, nothing here limits your right to bring proceedings in the courts of your country of residence or restricts your mandatory consumer protection rights. The EU dispute resolution platform is available at ec.europa.eu/consumers/odr.

Modifications to Terms

We may update these terms from time to time. Material changes will be communicated by email at least 30 days before taking effect. Continued use of the service after changes take effect constitutes acceptance.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
